Please read these Terms and Conditions carefully before using the SaleTides platform ("Service") operated by SaleTides ("us", "we", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
1. Acceptance of Terms
By creating an account or using SaleTides in any way, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and accept these Terms in full. If you are using the Service on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
SaleTides is a cloud-based sales analytics platform that connects to your WooCommerce store via API and provides dashboards, reporting, customer segmentation, cohort analysis, and AI-driven predictive analytics. The Service is provided on a subscription basis. Feature availability varies by plan.
3. Account Registration
You must register for an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@saletides.com of any unauthorised use of your account. We reserve the right to terminate accounts that violate these Terms.
4. Subscription & Billing
SaleTides offers monthly and annual subscription plans. By subscribing, you authorise us to charge your chosen payment method on a recurring basis. All fees are exclusive of applicable taxes. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. No refunds are issued for partial subscription periods.
5. Free Trial
We may offer a free trial period at our discretion. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial expires. We reserve the right to modify or discontinue free trials at any time without notice.
6. Acceptable Use
You agree not to misuse the Service. Prohibited activities include: attempting to gain unauthorised access to any part of the Service or its infrastructure; reverse engineering, decompiling, or disassembling the platform; using the Service to transmit malware or harmful code; reselling or sublicensing access to the Service without written consent; and scraping or harvesting data from the platform beyond normal use.
7. Your Data
You retain full ownership of all data imported into SaleTides from your WooCommerce store. By using the Service, you grant us a limited, non-exclusive licence to process your data solely for the purpose of delivering the Service to you. We do not sell your data to third parties. 8. Intellectual Property
The SaleTides platform, including all software, algorithms, designs, logos, and content, is the exclusive property of SaleTides and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written approval.
9. Third-Party Integrations
The Service integrates with third-party platforms such as WooCommerce. We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party services is governed by their respective terms and privacy policies.
10. Limitation of Liability
To the maximum extent permitted by law, SaleTides shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. AI-generated forecasts and insights are provided for informational purposes only and do not constitute financial or business advice.
12. Termination
Either party may terminate the agreement at any time. You may cancel your subscription at any time through your account settings. We reserve the right to suspend or terminate your account without notice if you breach these Terms. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our data retention policy.
13. Changes to Terms
We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or via an in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where SaleTides is registered.
